Title IX is a federal civil statute that prohibits anyone in an educational institution from discriminating on the basis of sex. The law was passed as part of the Education Amendments of 1972, and any education program operated with federal funds is required to follow this law.

Every year there are changes in all areas of law, and Title IX is no different. KJK Student and Athlete Defense is tracking the recently anticipated rule changes and in March 2021 wrote a detailed review of Biden’s executive orders and how they would affect how cases evolved.

President Biden issued executive orders to the Department of Education to review all of the Title IX regulations enacted by former Secretary of Education Betsy Devos. Devos held this position from 2017 to 2021 and made these additions in August 2020. These updates gave more due process rights to Title IX defendants accused of assault or harassment on educational premises.

While somewhat controversial, these updates did not in any way help people who did wrong. Their purpose was to ensure that no innocent person had to go through the stressful process.

The President most likely wanted these changes reverted with his order of review, although the instructions were not specific. Biden had signaled these regulations would be replaced during his campaign, when they were criticized by some women’s groups and Democrats.

Because the ordinance only required a review of the regulations, the Department of Education’s Office of Civil Rights did its job by publishing guidance evaluating all of the changes made to Title IX by Betsy Devos.

The government has indicated its intention to ensure that Title IX regulations are aligned with the priorities of the Biden-Harris administration by submitting the unified agenda for regulation and deregulation in the fall of 2021.

One cannot be certain of the outcome of these regulations. Yet President Biden is taking these actions to empower women and ensure education free from sexual violence. He said he would revive Obama-era guidelines to investigate cases of sexual harassment and assault in schools. Opponents of Devos and Biden supporters believe the 2020 changes would discourage victims from coming forward and make it easy for schools and attackers to get away with wrongdoing.
